Employment / Disability Discrimination

Six-figure settlement

Represented an employee who was subjected to a sustained period of performance management following a serious brain injury. Successfully argued the employer had failed in its duty to make reasonable adjustments and had constructively dismissed the claimant. The matter settled for a six-figure sum prior to final hearing.

Employment / Disability Discrimination

Five-figure settlement

Acted for a teacher who resigned from the profession after her employer repeatedly failed to implement reasonable adjustments for a disability. Advised on and drafted the ET1, prepared witness statements and negotiated a five-figure settlement at the conciliation stage, avoiding the need for a final hearing.

Employment / TUPE

£31,000 tribunal award

Represented a claimant whose employment was not correctly transferred during a TUPE transfer. Successfully established liability against the transferee (B) and secured a tribunal award of £31,000 in respect of the claimant's losses arising from the unlawful failure to transfer.

Employment / Holiday Pay

All 15 applications dismissed

Instructed on behalf of a respondent employer to defend 15 separate applications to extend time in a holiday pay claim. Successfully argued that each claimant had failed to demonstrate that it was not reasonably practicable to present their claims in time. All 15 applications to extend time were dismissed by the Tribunal.

D Ltd v I Ltd

Commercial / Breach of Contract

£866,000 contract dispute

Acted in a high-value breach of contract claim arising from an £866,000 contract for the construction of a large unit for creating mechanical structures. The defendant refused to make payment after the claimant had completed substantial preparatory work. Advised on liability, quantum and litigation strategy in connection with recovery of the sums due.

N v G Ltd

Commercial / Unlawful Detention of Goods

Goods returned in full

Acted for a manufacturing company whose contractor was unlawfully detaining a consignment of goods. Advised on the legal basis for recovery, drafted the pre-action correspondence and, following threatened injunction proceedings, successfully negotiated the return of the full consignment without the need for litigation.
