B v H Ltd
Employment / Disability Discrimination
Represented an employee who was subjected to a sustained period of performance management following a serious brain injury. Successfully argued the employer had failed in its duty to make reasonable adjustments and had constructively dismissed the claimant. The matter settled for a six-figure sum prior to final hearing.
C v E
Employment / Disability Discrimination
Acted for a teacher who resigned from the profession after her employer repeatedly failed to implement reasonable adjustments for a disability. Advised on and drafted the ET1, prepared witness statements and negotiated a five-figure settlement at the conciliation stage, avoiding the need for a final hearing.
C v A and B
Employment / TUPE
Represented a claimant whose employment was not correctly transferred during a TUPE transfer. Successfully established liability against the transferee (B) and secured a tribunal award of £31,000 in respect of the claimant's losses arising from the unlawful failure to transfer.
Claimants v H Ltd
Employment / Holiday Pay
Instructed on behalf of a respondent employer to defend 15 separate applications to extend time in a holiday pay claim. Successfully argued that each claimant had failed to demonstrate that it was not reasonably practicable to present their claims in time. All 15 applications to extend time were dismissed by the Tribunal.
W v NHS Trust
Employment / Whistleblowing
Represented a senior NHS employee who was subjected to a series of detriments after making protected disclosures about patient safety. Advised on the scope of whistleblowing protection under the Employment Rights Act 1996, drafted the ET1, and negotiated a six-figure settlement prior to the final hearing.
R v Local Authority
Employment / Age Discrimination
Acted for a claimant who was passed over for promotion on multiple occasions. Successfully argued at the Employment Tribunal that the respondent's selection criteria were indirectly discriminatory on grounds of age, establishing liability and securing a remedy hearing for compensation.
